Birmingham City Council could be forced to pay out up to £600m in equal pay case.

Thousands of female Birmingham City Council staff could receive a share of up to £600m in compensation after winning an equal pay employment tribunal case.

Up to 5,000 female workers, including cleaners, care assistants & cooks, brought the case against the council after they were not paid bonuses that were offered to male refuse collectors, allowing the men to earn more than £50,000 a year.

The tribunal found these bonuses were discriminatory because it was rewarding male workers for doing their jobs properly.  Read more

Risks such as:  

Discrimination: There is no statutory limit to the amount of compensation which an employment tribunal can award and the claimant requires no minimum length of employment. A claim can be brought against you as an employer due to your recruitment process and therefore you could have a claim against you when you never employed the claimant.

Unfair Dismissal: The maximum award for a compensation claim has now risen to £66,200 for such issues as not following correct procedure, or dismissal for an automatically unfair reason.

Breach of Contract: A breach of contract occurs when the employee or employer breaks one of the terms in an employment contract. The breach could be of a written term, a verbally agreed term, which is more difficult to prove or an implied term which could include previous custom and practice. The maximum claim limit is now £25,000.

Wrongful Dismissal: Damages are uncapped in the County or High Court, but in an Employment Tribunal the claim has a maximum compensation award of £25,000.

Failure of Proof of Right to Work in the UK: Employers can face unlimited fines if they employ illegal workers, and if you do not treat all job applicants equally you could fall into discrimination laws.
